SALES TERMS & CONDITIONS POLICIES

Ordering:

  1. All dealer orders must be by written purchase order and signed by an authorized agent of the company.

 

  1. All orders must be sent to: Modern DriveLine. 4216 Capital St. Caldwell, ID. 83605. Phone: (208) 453-9800 or can be sent via email to sales@moderndriveline.com

 

  1. Any account not on NET terms must be paid current to the terms agreement before any additional orders are shipped.
    A company check is not accepted for orders without prior approval.

 

Terms:

  1. A late charge of 2% (24% annually) will be added to all past due invoices, for those customers who were granted and currently enjoying terms from Modern Driveline.

 

  1. Modern DriveLine reserves the right to terminate any account that fails to make payment when due. Any account that is past due more than 60 days will no longer be considered an active account and all invoices due will be turned over for collection. The debtor will pay collection fees incurred as well as any incurred legal fees.

 

 

Freight:

  1. All Modern DriveLine shipments are F.O.B. 4216 Capital St. Caldwell, ID. 83605.

 

  1. All shipping discrepancies must be reported within (10) business days of receipt of shipments.

 

  1. Modern DriveLine reserves the right to choose the carrier on all prepaid shipments.

 

 

 

Return Policy:

  1. Any unauthorized return will be refused. You must call and speak to a sales representative to receive an RMA number (Return Merchandise Authorization) This number must be displayed on the outside of your package.

 

  1. Modern DriveLine will not accept returns over 30 days without prior approval.

 

  1. Modern DriveLine does not issue refunds in the form of cash, a credit will be applied to your credit card or to your account, or a cheque will be issued and sent by mail. In the case of a wire transfer or e-check on any merchandise returned pending approval after inspection.

 

  1. There may be a 15% restocking fee on certain accepted returns (as defined in RMA Policies & Procedures) and on all special orders.

 

  1. All orders must be inspected upon receipt. Damages should be reported to the carrier immediately when the shipment is received. Damaged goods are the responsibility of the shipping company. If the item was shipped by MDL via an approved carrier and was damaged, you must inform MDL and MDL will initiate a claim with the carrier.

 

  1. The seller disclaims all responsibility for consequential, incidental, or commercial losses including labor claims and rental vehicles. No Independent Representations or Agreements. There are no agreements outside of this written contract, except as the parties have agreed in writing, nor has either party been induced to enter into this agreement as the result of any oral representation or promise. Each party has relied on his own expertise and knowledge in entering into this contract and each party acknowledges the consideration for the contract to be valuable and sufficient.
    Duties: The duty of Modern DriveLine to the customer is strictly contractual and shall in no way exceed the duties accepted herein, and where there appears an ambiguity in the contract language, the same shall be construed to limit the duty of Modern DriveLine. Consent And Jurisdiction: The parties agree that any dispute arising out of parts, service or information provided by Modern DriveLine shall be decided by the courts of the State of Idaho and that no other court shall have jurisdiction over said dispute. Modern DriveLine maintains no sales force, service facility or agents outside the State of Idaho.
